1. Advisory work and litigation in High Court / Court of Appeal
1996 – 2018 – Advisory work and litigation in High Court / Court of Appeal for trusts / trust estates including Salim Talib Estate in the early 1990s and the Aljunied Estate and other estates thereafter.
2. Secured Mareva Injunction and damages for North Korean trading company
Acted in 2002 for a North Korean trading company as Plaintiff in High Court against a Singapore company involving breaches of contract for the sale of high speed diesel (HSD), leading to confiscation of ship by the North Korea government, arrest/detention of crew on criminal charges, where the client succeeded in obtaining a Mareva Injunction and was awarded damages and where the Court upheld the ‘Act of State’ doctrine. Witnesses included North Korean prosecutor/judge testifying in the High Court and on behalf of the North Korean government.
3. Acted for publicly listed Indian company in taxing down legal costs
Acted in early 2000s as counsel for Essar Steel, India (a publicly listed company in India) in taxing down costs of legal counsel, foreign legal counsel and experts involved in litigation in Singapore.
4. Appointed as Nominee under Bankruptcy Act to administer largest Singapore IVA
In January 2019, appointed as Nominee under the Bankruptcy Act, Singapore to administer an individual voluntary arrangement (IVA) for a Singaporean with debts both local and foreign exceeding S$400 million. This was adjudicated by the firm to around S$244 million as the largest IVA in Singapore. Mr Andre Arul also chaired the creditors meeting where the scheme of arrangement was voted for by a majority in number of the 39 creditors present and voting and more than 75% in value of the creditors present and voting, resulting in subsequent challenges and appeals in the High Court and Court of Appeal and a separate creditor High Court proceeding at trial.
5. Secured compensation and settlement for employees of financial institution
Acted in 2020 for the head and a high-level employee of a financial institution in Singapore and Hong Kong in a wrongful dismissal claim in the High Court against the employer. This resulted in an SIMC mediation where the institution head received substantial compensation, while the other employee secured a pre-action negotiated settlement.
6. Acted in software copyright enforcement case
Acted in 2020 – 2023 in enforcement of copyright for Turkish / Singapore developer / distributors of leading structural / architectural software in contested actions against infringement in the District Courts.
7. Acted on behalf of estates in family disputes involving Lasting Power of Attorney
Acted in 2021 to 2023 in family disputes in the High Court involving claims for damages for breaches of trust etc. on behalf of estates as well as 2 High Court actions regarding disputed and protracted Lasting Power of Attorney and deputyship applications regarding a mentally disordered person.
8. Settled negligence / breach of contract / breach of trust claims in client's favour
Advised/acted in 2021/2022 in a negligence / breach of contract / breach of trust claim in the High Court against stakeholder solicitors in Singapore that were successfully settled in the client’s favour in late 2023.
9. Acted in a case involving forgery and breach of contract
Acted in a matter involving a client’s claim for damages and losses arising from breaches of a Portfolio Advisory Service Agreement, as well as violations of the fiduciary duties owed between the client and a financial investment institution. The client claimed that the institution failed to act in a professional way, resulting in financial harm and a breakdown of trust in their relationship.
