1. Represented Japanese Claimant in construction of Indian power station
Assisting Counsel in early-1990s for a Japanese Claimant who was a contractor agent for an Indian state-owned entity for the construction of a power station in India in an ICC administered arbitration.
2. Secured award for Dutch Antilles company in breach of contract case
Acted as counsel for Claimant in a 2004 SIAC arbitration case against a Dutch Antilles respondent company claiming damages for breach of contract for the supply of military hardware, resulting in an award and successful enforcement of the award obtained.
3. Assisted in international arbitration matters as secretary to tribunal
Assisted a single arbitrator as secretary to the tribunal from commencement of arbitration in 2011 in an international contract/sale of goods claim involving steel/coils manufactured in Taiwan for delivery in Spain, which went on for a 5 day hearing in January 2013 in Singapore involving 2 expert witnesses and assisted in writing the award.
Assisted sole arbitrator as secretary to the tribunal from commencement of arbitration in 2013 in a SIAC Arbitration involving an Indonesian oil company, which was a subsidiary of British Petroleum PLC, and a defaulting Indonesian purchaser and assisted in writing the award.
4. Acted for and advised Marina Bay Sands (MBS) in arbitration involving damages claims
Acted for Marina Bay Sands (MBS) in an advisory capacity and advised in arbitration proceedings concerning a claim for damages against its joint venture partner of a major steel cladding supplier owned by Mittal Steel concerning the supply of materials and construction.
5. Acted for building construction contractors in litigation and arbitration matters
Acting for main contractors and subcontractors in building construction litigation in the Courts over the years as well as acting in an advisory capacity / drafting agreements holding a brief / advising a sub-contractor on an arbitration.
6. Assisted arbitrator panels in international shipping matters
Assisted Chairman of the 3 men Arbitral Tribunal in an international shipping arbitration and assisted in researching and writing of the majority award in an ad-hoc arbitration governed by HKAIC rules with 1 dissenting award.
Assisted arbitrator in a 2 arbitrator panel in an ad-hoc arbitration concerning a shipping cargo dispute concerning a vessel commenced in 2014 involving Indian parties for which the arbitral panel was reconstituted halfway and which concluded in 2018.
7. Advised investor and Malaysian-listed company in the sale and purchase of an established Indonesian tin-smelting company
Advised main investor and a Malaysian-listed company in 2015/2016 in 2 US multimillion dollar disputes regarding investment agreements with SIAC arbitration clauses involving the sale & purchase of a tin-smelting company in Indonesia with licenses, a plant, machinery and vessels. Advice was also provided in an additional related dispute under an Indonesian tin smelting agreement with an SIAC arbitration clause.
8. Represented company from China in SIAC arbitration contractual and intellectual property disputes
Acted as lead counsel for 2 China Respondent parties from a shipping company based in Dalian, China, in a claim by a Singapore shipping company listed on the main board in Singapore regarding a contractual and intellectual property licence dispute in SIAC Arbitration. This involved 2 Chinese law expert witnesses that proceeded for an expedited arbitration hearing on the merits on grounds including fraud in 2015, as well as liaised with Chinese counsel regarding submissions/decision and appeal before the China Trademark Tribunal, where client succeeded and assisted Chinese counsel in resisting arbitration enforcement proceedings.
9. Served as Singapore Counsel with Sri Lankan President's Counsel and other arbitrators in an ICC arbitration and lead counsel in a High Court challenge regarding a multimillion Euro contract for the Grand Hyatt Hotel
Instructed in 2016 as Singapore Counsel together with 4 Sri Lankan counsel, including a President's Counsel (PC) in an ICC arbitration with 3 arbitrators seated in Singapore by a Sri Lankan state-owned company concerning a dispute over a multimillion Euro contract granted to an Italian company by company appointees of a previous government of Sri Lanka regarding the interior design and fitting out of the Grand Hyatt Hotel in Colombo, Sri Lanka and subsequently as lead counsel for the applicant in a challenge to the arbitral award at the seat in the High Court in Singapore which came up for hearing in mid 2018.
10. Successfully set aside an SIAC arbitration award in Court of Appeal for Sri Lankan state-owned company
Instructed as lead counsel in 2018 by a Sri Lankan state-owned company being suppliers of armed guards with weapons from a floating armoury off Sri Lanka to ships plying the horn of Africa, to set aside in the High Court in Singapore a default SIAC arbitration award (where the former Chief Justice of Singapore Chan Sek Keong dissented), where the High Court judge at first instance decided against the client. The client then appealed to the Court of Appeal in 2019. The appeal was allowed in the client’s favour in May 2019 and the SIAC award was set aside with costs in a landmark case in arbitration law in Singapore.
Issues in the proceedings included corruption/criminal proceedings against the former chairmen of both parties, 3 former commanders of the Sri Lankan Navy and 2 Sri Lankan government ministers, one of whom was President of Sri Lanka till 2022.
11. Settled 2 SIAC arbitrations in client’s favour
Commencement of 2 SIAC arbitrations for the claimant in an investment agreement and loan agreement claim in March 2023 that were settled in the clients favour in late 2023.
12. Represented client from Dubai in an arbitration case
Successfully settled a shipping arbitration matter for a company based in Dubai, in the favour of our client.
13. Secured a settlement agreement for client in breach of investment contract case
Respondent breached financial contract and failed to pay her agreed share of investment funds and interest. The case developed into an SIAC arbitration matter, where a settlement agreement was successfully secured in favour of our client.
14. Representing a property developer with interests in Indonesia in breach of contract matter
Working as lead counsel in an ongoing case involving 1 SIAC Arbitration matter where the client’s claims relate to an investment agreement for the development of property in Indonesia, as well as for breaches of duty/losses incurred.
